Overview
Welcome to Revive Hockey. The terms “we,” “us,” and “our” refer to Revive Hockey LLC, doing business as Revive Hockey. We operate this store and website, including all related information, content, features, tools, products, and services, to provide you, the customer, with a curated shopping experience (the “Services”). Our store is powered by Shopify, which enables us to provide the Services.
These Terms of Service, together with the policies referenced in them (collectively, the “Terms”), describe your rights and responsibilities when you use the Services.
Please read these Terms carefully. They include important information about custom and preorder products, cancellations, warranties, disclaimers, and limitations of liability.
By visiting, interacting with, purchasing from, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Section 1: Access and accounts
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. If you allow a minor dependent to use the Services on a device you own, purchase, or manage, you are responsible for that use and for any purchases made with your authorization.
To use the Services or purchase our products, you may be asked to provide information such as your name, email address, billing information, payment information, and shipping address. You represent that all information you provide is accurate, current, and complete and that you have the right to provide it.
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. You may not sell, transfer, assign, or license your account to another person.
Section 2: Products and product information
We make reasonable efforts to describe and display our products accurately. Colors, finishes, carbon patterns, graphics, proportions, and other visual details may appear differently depending on your screen, lighting, photography, manufacturing process, and device settings.
Unless expressly stated otherwise, product weights are approximate. Normal manufacturing tolerances may cause the actual weight, balance, dimensions, finish, graphics placement, or appearance of a hockey stick to vary slightly from descriptions, photographs, prototypes, samples, or other sticks.
We do not guarantee that a product's appearance, feel, balance, flex profile, shooting characteristics, durability, or performance will match your personal preferences or expectations. Hockey-stick performance is subjective and depends on factors that include player technique, strength, playing conditions, stick configuration, and intended use.
Product descriptions, prices, specifications, options, and availability may change without notice. We may discontinue a product or limit quantities offered to any person, geographic region, or jurisdiction.
Section 3: Custom configurations and preorders
Revive Hockey products may be manufactured or ordered in batches according to customer-selected specifications. Available selections may include model, handedness, flex, blade curve, shaft dimensions, grip, length, graphics, personalization, or other options.
You are responsible for reviewing every selection before submitting your order and again before the applicable preorder cutoff. We are not responsible for an option selected incorrectly by the customer.
Payment is collected when an order is placed. You may request a cancellation or configuration change before the posted preorder cutoff by contacting us with your order number. A request is not effective until we confirm it in writing.
After the preorder batch has been submitted to production, custom orders generally cannot be changed, cancelled, returned, or exchanged except when required by law or when Revive Hockey approves a claim involving an incorrect item or manufacturing defect. Additional details are provided in our Preorder Policy and Refund Policy.
Production, import, and delivery timeframes are estimates rather than guaranteed delivery dates. Manufacturing, material availability, quality-control review, customs, freight, weather, carriers, government action, and other circumstances may affect timing. If a material delay occurs, we will communicate available options as required by applicable law.
Section 4: Orders
Submitting an order is an offer to purchase. We may accept or decline an order for legitimate reasons, including suspected fraud, payment problems, pricing or listing errors, inability to fulfill the selected configuration, shipping restrictions, or misuse of the Services. An order is accepted when we confirm acceptance and successfully process payment.
We may verify order information before acceptance. If we decline, change, or cancel an order, we will attempt to notify you using the email address, billing address, shipping address, or phone number provided with the order. If we cancel an order after collecting payment, we will issue an appropriate refund.
Please review your order carefully before submitting it. Cancellation, return, and exchange rights are governed by these Terms, our Preorder Policy, and our Refund Policy.
Purchases are intended for personal or household use unless we separately authorize resale or commercial distribution in writing.
Section 5: Prices, taxes, and billing
Prices, discounts, and promotions may change without notice. The price charged is the price in effect when the order is placed, subject to correction of an obvious pricing or listing error. Your order confirmation will show the amount charged.
Unless expressly stated otherwise, listed prices do not include shipping, handling, taxes, customs duties, brokerage charges, or import fees. Applicable charges will be displayed at checkout when reasonably available or assessed by the appropriate authority or service provider.
Promotions may have separate terms. If promotion terms conflict with these Terms, the promotion terms control for that promotion.
You agree to provide accurate and current purchase, payment, and account information. You represent that you are authorized to use the payment method submitted and agree to pay all authorized charges, including shipping and applicable taxes.
Section 6: Shipping and delivery
Shipping charges and available delivery methods are displayed at checkout when available. Delivery dates are estimates and are not guaranteed. We are not responsible for delays caused by manufacturing, customs, carriers, weather, incorrect addresses, or events outside our reasonable control.
You are responsible for providing a complete and accurate shipping address. Contact us promptly if an address needs to be changed. We cannot guarantee an address change after an order enters fulfillment.
When tracking is available, it will be sent to the email address associated with the order. Risk of loss passes to you upon confirmed delivery, except as otherwise required by law. If a shipment is lost or arrives damaged, contact us promptly with your order number, tracking information, and photographs when applicable so we can investigate and assist with a carrier claim or other appropriate resolution.

Section 7: Product use and safety
Ice hockey involves inherent risks of collision, impact, falling, cuts, equipment failure, and serious injury. No hockey stick is unbreakable. Sticks can crack, splinter, weaken, or break during normal or abnormal play, including through shooting, faceoffs, slashes, blocked shots, contact with boards, skates, pucks, or other equipment.
Inspect your stick before every use. Do not use a stick that is cracked, splintered, structurally damaged, altered in an unsafe manner, or otherwise appears unsafe. Stop using the stick immediately if damage develops. Follow all league rules and use appropriate protective equipment.
Nothing in this section excludes responsibility that cannot lawfully be excluded, including responsibility for a proven manufacturing defect where applicable law provides a remedy.
Section 8: Limited warranty
Revive Hockey provides a 30-day limited warranty covering verified manufacturing defects in materials or workmanship. The warranty period begins on the date of delivery or customer pickup.
The warranty does not cover normal wear, cosmetic damage, chips, scratches, misuse, abuse, improper storage, unauthorized alteration, damage from skate blades, slashes, impacts, blocked shots, faceoffs, or other damage caused by play rather than a manufacturing defect.
To request review, contact us within the warranty period and provide your name, order number, an explanation of what happened, and clear photographs of the full stick, affected area, and identifying details. Keep the stick until the claim is resolved.
For an approved claim, we may provide a repair, replacement, store credit, or refund as appropriate. Replacement timing may depend on inventory or the next production batch. The complete terms appear in our Limited Warranty. This warranty does not limit rights that cannot be excluded under applicable law.
Section 9: Intellectual property
The Services, including our trademarks, brand names, text, graphics, photographs, videos, audio, product designs, site design, and arrangement of content, are owned by or licensed to Revive Hockey and are protected by applicable intellectual-property laws.
These Terms permit personal, noncommercial use of the Services. Without our prior written permission, you may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit material from the Services except as allowed by law.
Revive Hockey names, logos, product names, designs, and slogans are trademarks or trade dress of Revive Hockey or its licensors. Shopify names and marks belong to Shopify. Other marks belong to their respective owners.
Section 10: Optional and third-party tools
The Services may provide access to tools, applications, payment methods, shipping services, reviews, or other functionality supplied by third parties. We do not control every aspect of those services.
Third-party tools are provided “as is” and “as available” to the extent permitted by law. Your use is subject to the third party's applicable terms and policies. We may add, change, or discontinue optional functionality at any time.
Section 11: Third-party links
The Services may contain links or embedded functionality supplied by third parties. We are not responsible for the content, accuracy, security, availability, products, or practices of third-party websites or services.
If you leave our Services to access a third-party site, you do so at your own risk. Review the third party's policies before providing information or completing a transaction. Questions about third-party products or services should be directed to that third party.
Section 12: Relationship with Shopify
Revive Hockey is powered by Shopify, which enables us to provide the Services. However, purchases from our store are transactions directly between you and Revive Hockey. Shopify is not the seller of Revive Hockey products and is not responsible for any aspect of a sale between you and Revive Hockey, including injury, damage, or loss arising from a purchased product. To the extent permitted by law, you release Shopify and its affiliates from claims arising from or related to your purchases from Revive Hockey.
Section 13: Privacy
Personal information collected through the Services is governed by our Privacy Policy. Certain information is also processed under the Shopify Consumer Privacy Policy.
Because Shopify hosts the Services, Shopify processes information about your access and use to operate and improve the platform. Information submitted through the Services may be shared with Shopify and service providers, including providers located outside your state or country, as described in the applicable privacy policies.
Section 14: Feedback and reviews
If you submit ideas, suggestions, reviews, photographs, videos, comments, or other feedback (“Feedback”), you grant us a nonexclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, distribute, and display that Feedback for operating, improving, and promoting the Services, subject to applicable privacy and publicity laws.
You represent that you own or have permission to submit the Feedback, that it does not violate another person's rights, and that you have disclosed compensation or incentives associated with it. You remain responsible for its accuracy and content.
We may monitor, edit, decline to publish, or remove Feedback that we reasonably believe is unlawful, misleading, abusive, obscene, infringing, malicious, or inconsistent with these Terms. We are not obligated to keep Feedback confidential, compensate you for it, or respond to it unless separately agreed in writing.
Section 15: Errors, inaccuracies, and omissions
Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to descriptions, specifications, configurations, pricing, promotions, shipping charges, timing, or availability.
We may correct errors, update information, or cancel an affected order at any time. If an order is cancelled after payment because of our error, we will issue an appropriate refund.
Section 16: Prohibited uses
You may use the Services only for lawful purposes. You may not use the Services to:

violate applicable law or another person's rights;

infringe intellectual property, privacy, publicity, or other legal rights;

harass, threaten, defame, abuse, or harm another person;

submit false, fraudulent, or misleading information;

distribute spam, malware, malicious code, or unauthorized solicitations;

impersonate another person or misrepresent your affiliation;

collect personal information without authorization;

interfere with the security, availability, or proper operation of the Services;

bypass access controls, fraud controls, rate limits, robot exclusions, or other safeguards; or

reproduce, scrape, extract, resell, or exploit a material portion of the Services without written authorization or a legal right to do so.
We may suspend or terminate access when we reasonably believe these Terms have been violated.
Section 17: Automated agents
If you deploy or direct software that acts autonomously or semi-autonomously on your behalf (an “Agent”) to access the Services, the Agent must identify itself accurately, comply with applicable law and published technical requirements, and not evade CAPTCHAs, access controls, security measures, or requests to stop accessing the Services.
We may restrict whether and how automated systems access or interact with the Services.
Section 18: Termination
We may suspend or terminate your access to the Services for a material violation of these Terms, suspected fraud, unlawful activity, a security risk, or other legitimate business reason. You remain responsible for amounts properly due before termination.
Provisions that by their nature should survive termination will remain effective, including provisions concerning intellectual property, feedback, disclaimers, limitations of liability, indemnification, governing law, and amounts owed.
Section 19: Disclaimer of warranties
Except for the express Limited Warranty and rights that cannot be excluded under applicable law, the Services and products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, title, durability, and non-infringement.
We do not guarantee that the Services will be uninterrupted, secure, timely, or error-free. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.
Section 20: Limitation of liability
To the fullest extent permitted by law, Revive Hockey and its owners, affiliates, employees, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost savings, loss of data, loss of use, or replacement costs arising from the Services or products, even if advised that such damages were possible.
To the fullest extent permitted by law, our total liability arising from a product or order will not exceed the amount you paid for the product giving rise to the claim.
These limitations do not apply where prohibited by law and do not exclude liability that cannot lawfully be limited, including liability for fraud, willful misconduct, or other non-waivable obligations.
Section 21: Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless Revive Hockey, Shopify, and their respective affiliates, owners, officers, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, and reasonable legal fees arising from your material breach of these Terms, violation of law, infringement of another person's rights, or unlawful misuse of the Services.
We will provide reasonable notice of an indemnifiable claim. Failure to provide prompt notice will relieve you of obligations only to the extent you are materially prejudiced. We may control the defense and settlement, but we will not agree to a settlement that imposes a nonmonetary obligation on you without your reasonable consent. You agree to cooperate in the defense.
Section 22: Severability
If a provision of these Terms is held unlawful, void, or unenforceable, it will be enforced to the fullest lawful extent and the unenforceable portion will be severed. The remaining provisions will continue in effect.
Section 23: Waiver and entire agreement
Our failure to enforce a right or provision is not a waiver of that right or provision.
These Terms and the policies incorporated by reference constitute the entire agreement concerning your use of the Services and supersede prior or contemporaneous communications on that subject, except for a separate written agreement signed by an authorized representative of Revive Hockey.
Section 24: Assignment
You may not assign or transfer these Terms or your rights or obligations under them without our prior written consent. We may assign these Terms as part of a merger, acquisition, financing, reorganization, sale of assets, or transfer of the business, or as otherwise permitted by law.
Section 25: Governing law and venue
These Terms and any separate agreement through which we provide Services are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Subject to applicable consumer-protection laws and any jurisdiction that cannot be waived, disputes will be brought in the state or federal courts serving Adams County, Colorado, and the parties consent to their jurisdiction and venue.
Section 26: Headings
Headings are for convenience only and do not limit or affect the interpretation of these Terms.
Section 27: Changes to these Terms
The current version of these Terms will be posted on this page. We may update these Terms by posting a revised version. When required by law, we will provide notice of material changes. Changes take effect on the date stated in the revised Terms or notice. Continued use after the effective date constitutes acceptance of the revised Terms to the extent permitted by law.
